How to Reduce Section 301 Tariffs When Importing AGV Forklifts from China

If you are sourcing AGV forklifts or autonomous material handling systems from China for the U.S. market, tariffs can quickly become one of the biggest hidden costs in your project.

Many buyers discover too late that a “good factory price” becomes far less attractive after Section 301 duties, customs classification issues, and compliance costs are added together. The good news: there are legal ways to reduce tariff exposure.

1. Which HTS Codes Carry the Lowest Duty Rates?

The first and most important factor is correct HTS classification. Many importers assume all AGVs use the same code, but duty rates vary based on:

  • Automation Level: Fully autonomous vs. semi-automatic.

  • Configuration: Forklift vs. pallet truck vs. tugger.

  • Power: Electric vs. combustion.

  • Specs: Maximum lifting height and load capacity.

Common HTS Categories:

  • 8427.10: Electric self-propelled trucks.

  • 8428.90: Other lifting/handling machinery (common for AMRs).

  • 8709.11: Electrical self-propelled work trucks (common for tuggers).

2. Can U.S. Assembly Qualify for Lower Tariffs?

Many U.S. importers reduce tariff impact by importing components separately and performing Final Assembly & Integration within the United States.

This involves shipping the chassis, battery systems, and sensors separately. However, to qualify, the process must meet the "Substantial Transformation" rule, which typically requires:

  • U.S.-based software deployment and calibration.

  • Adding local components (e.g., specific safety sensors).

  • Final safety certifications (like UL) conducted in the U.S.

3. Will a Certificate of Origin from a Third Country Help?

A Certificate of Origin from countries like Vietnam or Thailand does not automatically bypass Section 301 duties if the product's "essential character" was created in China.

Simply transshipping is considered duty circumvention. Ensure your supplier provides proof of a full manufacturing facility and detailed production records to pass a customs audit.
